Terms and conditions of sale
Translation provided for information purposes only; in the event of any discrepancy, the French version prevails, without prejudice to the mandatory provisions of the law of your country of residence.
Version in force as of 1 November 2026.
These general terms and conditions of sale (hereinafter the “GTC”) apply to sales of products concluded at a distance on the website https://masdesjeux.com (hereinafter the “Site”) between the company M.D.J, operating the brand “Mas des Jeux” (hereinafter the “Seller”), and any natural person acting for purposes outside their commercial, industrial, craft, liberal or agricultural activity (hereinafter the “Customer”).
Alcohol abuse is dangerous for your health; drink in moderation. The sale of alcohol to minors under 18 is prohibited.
Article 1 – Purpose and scope
The purpose of these GTC is to define the rights and obligations of the Seller and the Customer in connection with the online sale of the products offered on the Site (wines, beers, liqueurs and fine food products).
They do not apply to the rental of the estate’s holiday cottages (gîtes), nor to sales made directly in the physical shops, which are governed by separate terms.
The Site is reserved for consumers. Professionals (wine merchants, restaurateurs, works councils, etc.) are invited to use the “Professional offers” (“Offres pro”) form on the Site; their orders are governed by specific terms.
The Customer declares that they have read and accepted these GTC, by ticking the box provided for this purpose, before placing an order. The applicable GTC are those in force on the date of the order. They are accessible at any time on the Site and may be saved or printed by the Customer. The Seller may amend them at any time; amendments do not apply to orders already placed.
The GTC are drawn up in French. In the event of translation, only the French version is authoritative, without prejudice to the rights the Customer derives from the mandatory provisions of the law of their country of residence.
Article 2 – Identification of the Seller
The Site is operated by:
- M.D.J, a société par actions simplifiée à associé unique (SASU – simplified joint-stock company with a sole shareholder) with a share capital of 100 euros;
- registered with the Trade and Companies Register (RCS) of Tarascon under number 819 650 193;
- registered office: 33 rue Victor Hugo, 13460 Saintes-Maries-de-la-Mer, France;
- intra-Community VAT number: FR09819650193;
- excise number: FR017002E3893;
- e-mail: [email protected];
- telephone: +33 6 19 02 36 29 (06 19 02 36 29 from France; cost of a call to a French mobile number, depending on the Customer’s operator), Monday to Friday, 9 a.m. to 4 p.m. (excluding public holidays).
The Mas des Jeux wine estate is farmed organically, within the IGP (protected geographical indication) Sable de Camargue. The estate’s organic products are certified by Ecocert France (FR-BIO-01).
Article 3 – Products and sale of alcohol
3.1 Product characteristics
The essential characteristics of the products (name, vintage, volume, alcohol content, ingredients and allergens for foodstuffs, weight, price) are presented on each product page, in accordance with Articles L.111-1 and L.221-5 of the French Consumer Code (Code de la consommation) and Regulation (EU) No 1169/2011 on the provision of food information to consumers. The photographs are as accurate as possible; however, the label of a vintage may differ slightly from the image. In the event of a change of vintage, the product page is updated before any new order.
Foodstuffs bear a “use by” date or a “best before” date; the Seller endeavours to ship products whose date leaves a reasonable period for consumption.
Offers are valid while stocks last. Unavailable products are indicated on the Site.
3.2 Sale of alcohol prohibited to minors
In accordance with Article L.3342-1 of the French Public Health Code (Code de la santé publique), the sale of alcoholic beverages to minors is prohibited. Access to the Site is preceded by a declaration of legal age. For any order including an alcoholic beverage, the Customer must also certify, by ticking the box provided for this purpose, that they are at least 18 years old. This requirement applies whatever the country of delivery, even if the legislation of that country sets a lower age.
The Seller reserves the right to request proof of legal age at any time, to cancel and refund an order in the event of serious doubt as to the Customer’s age, and to refuse to hand over a parcel containing alcohol to a person unable to prove they are of legal age when collecting in a shop. The Customer undertakes not to have a parcel containing alcohol collected by a minor.
The Customer undertakes to purchase the products for personal or family use and not for resale.
The Seller holds an excise number (FR017002E3893). Alcoholic beverages are shipped accompanied by the tax documents required by excise regulations.
Article 4 – Prices
Prices are stated in euros, all taxes included (TTC), excluding delivery charges. They include VAT at the rate applicable on the date of the order (in particular 5.5% for food products and 20% for alcoholic beverages) as well as the excise duties and levies on alcoholic beverages due in France, paid by the Seller under its excise number. Alcoholic beverages are delivered in France only (article 7.1).
Delivery charges are calculated according to the total weight of the parcels and the country of delivery. They are shown to the Customer before the order is confirmed and appear on the order summary. The VAT applied to delivery charges follows that of the products contained in the parcel, in proportion to their value.
The applicable price is the one displayed on the Site when the order is confirmed. The Seller may change its prices at any time, but products are invoiced at the price in force when the order is recorded.
Any discount codes may be used under the conditions (duration, minimum amount, products concerned, number of uses) stated when they are issued. They cannot be combined with one another: only one code may be used per order. They cannot be exchanged for cash.
Any announcement of a price reduction complies with Article L.112-1-1 of the French Consumer Code (reference price = the lowest price applied during the 30 days preceding the reduction).
Article 5 – Orders
5.1 Ordering steps
Orders are placed without creating a customer account. To place an order, the Customer:
- adds the chosen products to their basket and may change its contents at any time;
- enters their e-mail address, surname, first name and telephone number;
- chooses the country and method of delivery (pick-up point, or free collection in a shop in France) and, where applicable, their address and the pick-up point of their choice;
- checks the order summary (products, quantities, prices, delivery charges, any discount, total price including taxes) and may correct any errors;
- certifies that they are at least 18 years old if the order includes alcohol, and accepts these GTC by ticking the corresponding boxes;
- confirms the order by clicking on the “Payer ma commande” (“Pay for my order”) button, which entails an obligation to pay, and then proceeds to payment on the payment service provider’s secure page.
5.2 Conclusion of the contract and confirmation
The sales contract is concluded when payment is confirmed by the payment service provider. The Seller then sends the Customer, by e-mail, an order confirmation summarising the essential elements of the contract, with a link to these GTC. An order whose payment has not been completed is not recorded as firm.
The Seller reserves the right to refuse or cancel an order for a legitimate reason, in particular in the event of an existing dispute with the Customer, suspected fraud, doubt as to the Customer’s legal age, an order that is abnormal with regard to personal use, or an obvious pricing error. The Customer is informed and, if they have already paid, refunded in full.
5.3 Unavailability after ordering
If an ordered product turns out to be unavailable after the order, the Seller informs the Customer by e-mail or telephone as soon as possible. The Customer may then choose, as the case may be, the cancellation of all or part of the order with a refund of the corresponding sums no later than 14 days after payment, or, if they expressly accept it, a product of equivalent quality and price or a credit note.
5.4 Tracking, invoice and archiving
The Customer may follow the status of their order on the Site’s “Order tracking” (“Suivi de commande”) page, using their order number and e-mail address, or via the link in the order e-mails. The invoice is sent to the Customer by e-mail when the order is shipped (or, in the case of collection in a shop, when the order is made available).
In accordance with Article L.213-1 of the French Consumer Code, where the order amounts to 120 euros including taxes or more, the Seller keeps the written record of the contract for ten years from delivery and guarantees the Customer access to it upon simple request to the e-mail address given in Article 2.
The Seller’s computerised records, kept under reasonable security conditions, constitute evidence of the communications, orders and payments between the parties, unless the Customer provides evidence to the contrary.
Article 6 – Payment
The total price of the order is payable in full at the time of ordering. No deposit or down payment (acompte or arrhes) is required.
Payment is made on the secure page of Stripe, a payment service provider. Via Stripe, the Customer may pay by bank card (in particular CB, Visa, Mastercard), Apple Pay, Google Pay, Link, Amazon Pay or PayPal. The methods actually available may vary according to the Customer’s device, browser and country; they are displayed on the payment page. The use of Amazon Pay, PayPal or Link may be subject to those services’ own terms.
Payment data are transmitted directly and in encrypted form to Stripe; the Seller never has access to card numbers and does not store them.
The order is confirmed only after the Seller has received confirmation of payment from Stripe. If payment is refused or fails, the order is not confirmed and the basket remains available.
The products remain the property of the Seller until the price has been received in full.
Article 7 – Delivery
7.1 Countries and methods of delivery
The Site delivers exclusively to pick-up points, in the following countries: metropolitan France, Belgium, Luxembourg, Spain, the Netherlands, Germany, Italy and Portugal. No home delivery is made, nor delivery to other countries, in particular the United Kingdom, Switzerland and Austria.
Alcoholic beverages (wines, beers, etc.): delivery in France only. Distance selling of alcohol to another European Union Member State requires the Seller to complete customs formalities and pay excise duties in the country of destination. The Seller therefore only delivers alcoholic beverages within metropolitan France (pick-up point or collection in store). All other products are delivered to every country listed above. An order containing alcohol can only be confirmed if the delivery address is in France.
Parcels are shipped by Mondial Relay to the pick-up point chosen by the Customer when ordering. Where it considers it preferable (availability, lead time, cost), the Seller may ship the parcel with another carrier (in particular Chronopost, Colis Privé or Colissimo) to another pick-up point located near the chosen point. In that case, the Customer is informed by e-mail, before or at the time of shipment, of the address of the new collection point; this change is free of charge for the Customer.
In France, the Customer may also choose free collection of their order in one of the shops indicated when ordering (currently in Aigues-Mortes – 2 and 14 rue Émile Zola – and in Saintes-Maries-de-la-Mer – 33 rue Victor Hugo), during the displayed opening hours. The Customer is notified by e-mail when their order is ready. The order remains available for one week from that e-mail; it is handed over on presentation of an identity document, which also makes it possible to check that the Customer is of legal age when the order includes alcohol. After this period, the Seller contacts the Customer; failing collection or reply, the order may be cancelled and refunded under the conditions set out in Article 7.4 for uncollected parcels.
7.2 Charges and parcels
Delivery charges to a pick-up point depend on the weight and the country of destination; they are displayed in the basket and before the order is confirmed. A parcel may not exceed 30 kg or contain more than 12 bottles of wine. Beyond that, the order is shipped in several parcels and the delivery charges for each parcel are added together; the number of parcels is shown before the order is confirmed.
Where applicable, delivery to a pick-up point may be offered free of charge above a certain purchase amount and for the countries indicated on the Site at the time of ordering.
7.3 Lead times
Orders are prepared within 2 to 5 working days of confirmation of payment. Mondial Relay’s indicative transit time is 3 to 5 working days after shipment, depending on the country of destination. The Customer receives an e-mail upon shipment, with a tracking number.
In any event, and unless otherwise agreed, the Seller undertakes to deliver the order no later than 30 days after the conclusion of the contract. If this deadline is exceeded, the Customer may, under the conditions of Articles L.216-6 and L.216-7 of the French Consumer Code, require the Seller to deliver within a reasonable additional period and then, failing that, terminate the contract by registered letter or by a written document on another durable medium, and be refunded no later than 14 days thereafter.
7.4 Collection of the parcel and transfer of risk
The parcel is made available at the pick-up point (or, where applicable, in an automated parcel locker) for the period set by the carrier’s terms (Mondial Relay or Chronopost), stated in the arrival notification e-mail or text message sent by the carrier; this period may be only a few days, particularly for automated lockers. The Customer is invited to collect their parcel without delay. The parcel is handed over on presentation of an identity document and/or the collection code provided by the carrier. The Customer must provide accurate information; the Seller cannot be held liable for a delay due to an input error by the Customer.
If the parcel is not collected within this period, it is returned to the Seller. The Seller then contacts the Customer, who may request a new shipment, at their own expense, or a refund of the price of the products, less the initial shipping and return costs borne by the Seller. Perishable foodstuffs that are no longer fit for consumption on their return are not refunded.
In accordance with Article L.216-4 of the French Consumer Code, the risk of loss of or damage to the products passes to the Customer when they take physical possession of the products, i.e. when the parcel is collected at the pick-up point or in the shop.
7.5 Receipt
The Customer is invited to check the condition of the parcel when collecting it and, in the event of damage (damaged parcel, broken bottle, missing product), to make specific reservations with the pick-up point and to inform the Seller as soon as possible, with photographs if possible, at [email protected]. These steps make it easier to handle the claim with the carrier, but failing to take them does not deprive the Customer of the legal guarantees provided for in Article 9.
Article 8 – Right of withdrawal
8.1 Period
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days in which to exercise their right of withdrawal, without having to give reasons for their decision or bear any costs other than those mentioned below. This period runs from the day on which the Customer, or a third party designated by them other than the carrier, takes physical possession of the products. For an order delivered in several parcels, the period runs from receipt of the last parcel. Where the period expires on a Saturday, Sunday or public holiday or non-working day, it is extended until the next working day.
8.2 Exceptions
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:
- goods liable to deteriorate or expire rapidly (Article L.221-28, 4°): on the Site, this concerns only bull charcuterie (bull saucissons and chorizos). Terrines, canned gardiane and the other fine food products do not fall within this exception and may be the subject of a withdrawal, subject to the following exception if they have been opened;
- goods that have been unsealed by the Customer after delivery and that cannot be returned for reasons of hygiene or health protection, in particular uncorked bottles or bottles whose capsule has been removed, and foodstuffs whose packaging has been opened;
- goods made to the Customer’s specifications or clearly personalised (for example a gift box made up or personalised on request);
- goods which, after delivery and by their nature, are inseparably mixed with other items.
The wines, beers and liqueurs sold on the Site, delivered within days of the order at a price fixed at the time of ordering, do not fall within the exception for alcoholic beverages whose delivery is deferred beyond 30 days and whose value depends on market fluctuations: they may therefore be the subject of a withdrawal, provided they have not been opened.
8.3 Exercising the right of withdrawal
To exercise the right of withdrawal, the Customer notifies the Seller of their decision, before the period expires, by means of an unequivocal statement:
- by e-mail to [email protected];
- by post to: M.D.J – Mas des Jeux, 33 rue Victor Hugo, 13460 Saintes-Maries-de-la-Mer, France;
- online, using the withdrawal function available at https://masdesjeux.com/retractation or via the “Se rétracter du contrat ici” (“Withdraw from the contract here”) button on the “Order tracking” page, throughout the withdrawal period. The Customer enters their name, order number, the e-mail address used for the order and, if they wish, the products concerned, and then confirms the withdrawal by clicking a confirmation button.
The Customer may use the model withdrawal form set out in the annex, but this is not compulsory. It is recommended to state the order number. The Seller acknowledges receipt of the withdrawal without delay on a durable medium: where the online function is used, an acknowledgement of receipt setting out the content of the statement and its date and time is automatically sent to the Customer by e-mail. The withdrawal is deemed to have been exercised within the period if the Customer sent it before the period expired.
8.4 Return of the products
The Customer sends back the products, without undue delay and no later than 14 days after communicating their decision to withdraw, to the following address: Mas des Jeux – Retours, 2 rue Émile Zola, 30220 Aigues-Mortes, France. The Customer may also, if they wish and with the Seller’s agreement, bring the products back to one of the shops mentioned in Article 7.1.
The direct costs of returning the products are borne by the Customer. The Customer is invited to pack the bottles carefully to avoid any breakage in transit. The Customer may be held liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
8.5 Refund
The Seller refunds all sums paid, including the initial delivery charges (with the exception of any additional costs resulting from the Customer’s choice of a delivery method more expensive than the standard delivery method offered), no later than 14 days after the date on which it is informed of the Customer’s decision to withdraw. In the event of partial withdrawal, the initial delivery charges are refunded in proportion to the products returned. The Seller may withhold the refund until it has received the products back or until the Customer has supplied proof of having sent them, whichever is earlier.
The refund is made using the same means of payment as used for the initial transaction, unless the Customer expressly agrees to another means, and does not give rise to any fees for the Customer.
Article 9 – Legal guarantees
All products sold on the Site benefit from the legal guarantee of conformity provided for in Articles L.217-1 et seq. of the French Consumer Code and the guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code. These guarantees apply independently of any commercial guarantee; the Seller does not offer any commercial guarantee.
A Customer wishing to invoke either of these guarantees contacts the Seller at [email protected] or by post at the registered office, stating their order number, the product concerned and the nature of the defect (with photographs, if possible). For foodstuffs and beverages, the assessment of the defect takes into account their nature and their durability date; a wine with a defect (for example a “corked” wine) is replaced or refunded.
Legal information on the legal guarantee of conformity and the guarantee against hidden defects (Article D.211-2 of the French Consumer Code):
The consumer has a period of two years from delivery of the goods to obtain the application of the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to supply all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
- the professional refuses to repair or replace the goods;
- the repair or replacement of the goods takes place after a period of thirty days;
- the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
- the lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights mentioned above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who in bad faith obstructs the application of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee gives entitlement to a price reduction if the goods are kept or to a full refund against return of the goods.
Article 10 – Liability
The Seller is liable as of right to the Customer for the proper performance of the obligations arising from the distance contract, whether these obligations are performed by the Seller itself or by other service providers (in particular carriers), in accordance with Article L.221-15 of the French Consumer Code. It may, however, be exempted from all or part of its liability by proving that the non-performance or improper performance is attributable either to the Customer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
The products must be stored and consumed under normal conditions (temperature, storage after opening, dates indicated). The Seller cannot be held liable for the consequences of inappropriate storage after the products have been handed over, nor for excessive consumption of alcohol.
The Seller uses reasonable means to ensure access to the Site, without being able to guarantee permanent availability. No clause of these GTC is intended to or has the effect of limiting the rights the Customer derives from the law, nor the Seller’s liability in the event of gross negligence, wilful misconduct or personal injury.
Article 11 – Personal data
The personal data provided by the Customer when ordering are processed by M.D.J, as data controller, for the management of the order, delivery, invoicing and customer relations, and for compliance with its legal obligations. They are transmitted only to the service providers necessary for the performance of the order (payment, transport, hosting, sending of e-mails).
The terms of this processing, the retention periods and the Customer’s rights (access, rectification, erasure, restriction, objection, portability, complaint to the CNIL) are described in the Site’s Privacy Policy.
In accordance with Article L.223-1 of the French Consumer Code, a Customer who does not wish to receive telephone marketing may register free of charge on the Bloctel telephone marketing opt-out list (www.bloctel.gouv.fr).
Article 12 – Intellectual property
The texts, photographs, logos, trademarks and other elements of the Site are the property of the Seller or its partners and are protected by intellectual property law. Any reproduction or representation, in whole or in part, without prior written authorisation, is prohibited. The sale of the products does not entail any transfer of intellectual property rights.
Article 13 – Complaints, mediation and disputes
13.1 Customer service
For any question or complaint, the Customer may contact the Seller by e-mail at [email protected], by telephone on +33 6 19 02 36 29, via the Site’s contact form or by post at the registered office. Customer service answers the telephone Monday to Friday from 9 a.m. to 4 p.m., and endeavours to reply to e-mails and messages within 2 working days.
13.2 Consumer mediation
In accordance with Articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved after a prior written complaint to the Seller, the Customer may refer the matter free of charge to the consumer mediator to which the Seller belongs:
the name and contact details of the mediator will be given here as soon as membership has been finalised; in the meantime, the Customer may contact us by the means indicated in Article 2.
The Customer may refer the matter to the mediator within one year of their written complaint to the Seller. Recourse to mediation is optional; the Customer remains free to bring the matter before the competent courts.
Customers residing in another Member State of the European Union may also obtain free information and assistance from the European Consumer Centre France (www.europe-consommateurs.eu) or from the European Consumer Centre of their country of residence.
Article 14 – Applicable law and competent courts
These GTC and the sales contracts they govern are subject to French law. In accordance with Article 6 of Regulation (EC) No 593/2008 (“Rome I”), this choice may not have the effect of depriving a Customer residing in another Member State of the European Union of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence.
Failing an amicable solution or mediation, any dispute falls within the jurisdiction of the competent courts under the ordinary rules of law. A Customer residing in France may bring proceedings, at their choice, in addition to one of the courts having territorial jurisdiction under the French Code of Civil Procedure, before the court for the place where they resided at the time the contract was concluded or the harmful event occurred (Article R.631-3 of the French Consumer Code). A Customer residing in another Member State of the European Union may bring proceedings before the courts of the State of their domicile or of the State of the Seller’s registered office, and may only be sued before the courts of the State of their domicile, in accordance with Articles 17 and 18 of Regulation (EU) No 1215/2012.
Article 15 – Miscellaneous provisions
Should any clause of these GTC be declared null and void or unenforceable, the other clauses shall remain in full force and effect. The fact that the Seller does not rely on a clause at a given time does not constitute a waiver of the right to rely on it subsequently.
The Seller cannot be held liable for failure to perform its obligations in the event of force majeure within the meaning of Article 1218 of the French Civil Code.
